State High Court Declines to Review Airport Ruling

 Transportation: Decision should allow development of new passenger terminal in Burbank to move forward

BURBANK The state Supreme Court, without comment, refused Thursday to review a lower court ruling affirming the city of Burbank's power over land-use decisions at Burbank Airport, officials said.

The state Court of Appeal had previously ruled the city of Burbank, not the Burbank--Glendale--Pasadena Airport Authority, had the power to decide on a new terminal. The Airport Authority had argued that Burbank had ceded that power when it agreed to creation of the Airport Authority in 1977.The Court of Appeal ruling was one in a series of events that culminated with a tentative accord last week between the city and airport to allowing for construction of a new 14-gate terminal.

A lawyer for Burbank said the Supreme Court's decision not to review that decision was an important one. "This solidifies the legal relationship between the Airport Authority and the city and eliminates any doubt that a negotiated settlement was in everybody's best interest," said Peter Kirsch, special counsel for the city of Burbank.

In other developments, the city of Burbank is expected to consider the first formal agreement to implement the framework for the three-phase terminal plan. Burbank residents will get their first chance to voice opinions on the issue on Thursday.
