UPDATE ON VARIANCE PROCEEDINGS
We have just concluded almost two and one-half weeks of hearings on the VNY Variance before Adm. Law Judge Samuel D. Reyes. These hearings involved extensive examination of witness and numerous exhibits. I am pleased that we have been able to introduce a great deal of testimony and exhibits which will help make our case and support our proposed conditions.
The Airport (Respondent) put on a five day case in chief, followed by a four day case in chief by Intervenor "B". Intervenor "A" based its case on cross examination of witness presented by the other parties, rather than presenting a case in chief. Intervenor "C" (the airport tenants) put on a short, two hour case in chief and only called three witnesses. At the end of the lengthy two and one-half week hearing which involved hundreds of exhibits and dozens of witnesses, the Airport decided not to present any rebuttal case.
What remains now is the submission of legal briefs on the issues. These briefs are to be filed by all parties and summarize their legal arguments and conditions that they wish imposed on the Airport. These must be based upon the testimony, exhibits and evidence brought out during the hearing.

No additional court hearings are scheduled. Upon the submission of the briefs, the judge will issue a proposed order, and then a final order in this matter. This should be sometime in the first quarter of next year.
