The next court hearing will be on June 18th and I suggest that you attend and observe. This will be the fourth Pre-hearing Conference and it will address the contested issues in discovery. It is important that all Intervenors continue to monitor the progress of the variance:

During the past several months there has been an exchange of discovery pleadings between the parties. We have sought to introduce evidence relating to the negative impacts of noise, economic and technological feasibility of reducing noise, etc. Both the airport (Respondent), and the Class "C" Intervenors (Tenants) want to keep out virtually all of our evidence from the hearing. We on the other hand believe that it is critical to include it in the evidence produced at trail. As before these briefs have taken a lot of time to prepare and to respond to. Copies of all papers that were filed with the judge, and other Intervenors are available for your inspection.
Sandy Brown (Senator Tom Hayden), several attorneys, including Sheldon Rosenfield and myself have worked hard on the Pre-hearing Conference Statement and responses to Motions in Limine. I believe we have a strong case to allow our evidence into the record. The judge will make his decision on this important matter at the next hearing on June 18th.
At the request of Intervenor Group "A" (those within the 65 CNEL), they wish to work independently of us. They believe that joint or duplicative motions we filed, the judge would amalgamate both Intervenor Group "A" and "B". I personally do not agree with the view that he would join both Intervenors into one group. However, I respect group "A"'s decision to file separate motions and work independently.
