1. Pending determination of whether a Reconsideration and Correction of a Mistake in Decision is appropriate, Intervenor "B", moves the California Department of Transportation (Caltrans), under Government Code section 11518.5 and 11519 for a Stay of Execution of the order adopted on May 18, 2000, granting Respondent Los Angeles World Airways (LAWA)'s application for a Variance for Van Nuys Airport (Airport/VNY), pursuant to Title 21, California Code of Regulations, section 5050 et seq., in order to continue its operation of the Airport at a level which generates in excess of the regulatory-mandated level of aircraft noise. This request for the stay order is made under California Government Code Sections 11518.5 and 11519 on the grounds that crucial mistakes and clerical errors were found in the Court's Proposed Decision and flaws present in the Court's legal analysis that affect the Court's final recommendations. A stay will preserve the status quo while these critical errors are resolved.
2. This motion is based on the attached documents and exhibits including Class "B" Intervenors' Notice of Motion for Reconsideration of Caltrans order adopting Proposed Decision (Van Nuys Airport; Motion for a Correction of a Mistake in a Decision, Class "B" Intervenors' Memorandum of Points and Authorities in support of Motion for Reconsideration of Caltrans order adopting Proposed Decision (Van Nuys Airport); Motion for a Correction of a Mistake in a Decision, dated June 1, 2000, and on all papers filed and records in this action, and on any evidence received at the hearing.
