RE: UPDATE ON VARIANCE PROCEEDINGS - TRIAL DATE 9/13/99
The next court hearing will be on Sept.13th, when the Van Nuys Airport Variance hearing is scheduled to begin. The judge has scheduled two weeks for the hearing. Sept. 28th has been set aside for public comment. I suggest that you attend and observe as many trial days as you can, since it is open to the public. This will help you frame any comments that you wish to make during the Public Comment day scheduled for Sept. 28th. It is important that all Intervenors continue to monitor the progress of the variance:

During the past several months there has been a further exchange
of discovery documents between the parties. We have sought to
introduce evidence relating to the negative impacts of noise,
economic and technological feasibility of reducing noise, and
absence of good faith by LAWA, etc.
Both the airport
(Respondent), and the Class "C" Intervenors (Tenants) sought to
keep out many of our documents from evidence. We believe that we
have been reasonably successful in keeping in most of our crucial pieces of evidence. Copies of all papers that were filed with the
judge, and other Intervenors are available for your inspection.
Sandy Brown (Senator Tom Hayden), several attorneys, including Sheldon Rosenfield and myself have worked hard on the preparing for the somewhat lengthy trial.
If you wish to make a statement on the Public Comment day, Sept. 28th, you must contact Caltrans, and ask to be included on the speakers list. I suggest that you contact Sandy Brown at Sen. Tom Hayden's office, (310)441-9084, and ask her to assist in getting your name on Caltran's list for Sept. 28th.
